I've got the Gemini wi-fi version.

What I want to know is can it not go higher than than Android 8.1?

No, it can't, unfortunately.

Even 8.1 isn't very stable.

Only OS that receives updates is Sailfish as far as I am aware, but it is rather being maintained rather than being developed on.

It is really not bad at all, and I also bought a license to support development, but the volunteers who contribute on apps like to work on newer devices is my impression.
There may be potential for running android apps, but last time I checked a few pieces were still missing.
